This Jewelry Care, Use & Liability Disclaimer (“Disclaimer”) applies to all jewelry products and services provided by Balboa Gold, including but not limited to everyday jewelry, custom jewelry, charm jewelry, permanent jewelry, and in-store or off-site services.

By purchasing, wearing, or receiving jewelry from Balboa Gold, you acknowledge and agree to the following:

1. General Jewelry Wear & Care

All jewelry is subject to normal wear and tear. Longevity may be affected by factors including, but not limited to:

  • Daily wear

  • Exposure to water, chemicals, lotions, perfumes, and sweat

  • Physical activity, impact, or tension

  • Individual skin chemistry

Balboa Gold is not responsible for damage, breakage, stretching, tarnishing, or loss resulting from normal use, improper care, or external factors after purchase.

2. Materials, Sourcing & Skin Sensitivities

Balboa Gold curates and resells jewelry from a variety of independent designers, manufacturers, and suppliers. Balboa Gold does not manufacture jewelry directly.

Material descriptions and classifications (including but not limited to gold-filled, sterling silver, solid gold, or other metals) are provided based on information disclosed by our suppliers and designers at the time of purchase.

While Balboa Gold makes reasonable efforts to accurately communicate material information, we do not independently test or verify the composition of materials provided by third-party suppliers and are not responsible for inaccuracies, misclassification, or inconsistencies provided by those suppliers.

  • Gold-filled jewelry is not solid gold and may experience wear over time.

  • Skin reactions and sensitivities vary by individual.

Balboa Gold is not responsible for allergic reactions, skin sensitivities, or material inconsistencies. Customers are responsible for disclosing known allergies prior to purchase or service.

3. Small Parts & Choking Hazard Warning

Some Balboa Gold jewelry contains small parts or detachable components that may pose a choking or ingestion hazard.

  • Jewelry is not intended for children

  • Not recommended for individuals who may place items in their mouth

  • Jewelry should be kept out of reach of children and pets

Balboa Gold is not responsible for injury, ingestion, or choking resulting from misuse or improper handling of jewelry products.

4. Custom & Charm Jewelry

All custom, personalized, or charm-based jewelry is made to order.

  • Minor variations are normal and expected

  • Custom and charm jewelry is final sale

  • Balboa Gold is not responsible for changes in preference, fit, or wear after completion

5. Permanent Jewelry

Permanent jewelry is applied using professional welding equipment and is intended for long-term wear.

By receiving permanent jewelry, you acknowledge and agree that:

  • Jewelry may break, stretch, or require removal over time

  • Removal may be required for medical procedures, travel, or safety reasons

Permanent jewelry is a custom service and is final sale.

6. Sizing Responsibility

Customers are solely responsible for selecting correct sizing, chain styles, and charm selections. Balboa Gold is not liable for sizing issues once an order or service is completed.

7. Repairs & Adjustments

Repairs or adjustments may be offered at Balboa Gold’s discretion. Fees may apply depending on the nature of the repair, time since purchase, and material.

Balboa Gold does not guarantee that all items can be repaired.

8. Limitation of Liability

To the fullest extent permitted by law, Balboa Gold shall not be liable for any indirect, incidental, or consequential damages. Liability, if any, shall not exceed the original purchase price of the jewelry or service.

9. Assumption of Risk

By purchasing or wearing jewelry from Balboa Gold, you voluntarily assume all risks associated with the use, wear, and care of jewelry products.

10. Governing Law

This Disclaimer shall be governed by the laws of the State of California.
